Psilocybin Freedom Act

AN ACT relative to psilocybin as a controlled substance.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Amend RSA 172:1 XX. to read as follows:
XX. “Hallucinogenic drugs” are psychodysleptic drugs which assert a confusional or disorganizing effect upon mental processes or behavior and mimic acute psychotic disturbances. Exemplary of such drugs are mescaline, peyote, psilocybin and d-lysergic acid diethylamide.

2 Amend RSA 318-B:1 XIII. to read as follows:
XIII. “Hallucinogenic drugs” are psychodysleptic drugs which assert a confusional or disorganizing effect upon mental processes or behavior and mimic acute psychotic disturbances. Exemplary of such drugs are mescaline, peyote, psilocybin and d-lysergic acid diethylamide.

3 New Paragraph; psilocybin. Amend RSA 318-B:1-a by inserting after paragraph VIII the following new paragraph:
IX. Psilocybin shall not be designated as a controlled substance.

4 Effective Date. This act shall take effect upon passage.
